1. Scope and nature of our Service

Through the Platform, Ricardo García Heredia (SimplyHosted) provides an online platform through which the owners of Viviendas de Fines Turísticos, clients of Ricardo García Heredia (SimplyHosted), can advertise, advertise, sell, promote and / or offer (as applicable) your properties so that they are requested, bought, reserved, rented or contracted. By using the Travel Service (eg when making a Travel Reservation through the Travel Service), you establish a direct (legally binding) contractual relationship with the property owner with whom you have reserved. From the moment you make your Travel Reservation, we only act as intermediaries between you and the owner. Ricardo García Heredia (SimplyHosted) does not (re) sell, rent or offer any type of (travel) product or service. Our Travel Service is available only for personal, non-commercial use. Therefore, it is not allowed to resell, deep-link, use, copy, monitor (eg spider, scrape), display, download or reproduce the content, information, software, reservations, tickets, products or the services available on our Platform for any commercial or competitive activity or purpose.

2. Payment

Payment is made during the booking process through a secure online payment system (provided that your bank supports it).Payment is processed securely from your credit/debit card or from your account to the hosting provider's account using an external payment processor. All payments provided by us for and on behalf of, and transferred to the owner will in each case constitute your total payment of the reservation price of the corresponding product or service as a final settlement of each price due and payable. You will not be able to claim these amounts paid. In the event of fraud or unauthorized use of your credit card by third parties, most banks and credit card issuing companies bear the risk and cover all expenses resulting from such fraud or misuse which, on occasion, may be subject to a deductible (normally EUR 50 or the equivalent in local currency). In the event that the credit card issuing company or the bank charges you said franchise due to unauthorized transactions resulting from a reservation made on our Platform, we will pay you such franchise, up to a total amount of EUR 50 (or the equivalent in your local currency). In order to compensate you, report this fraud to the company that issues your credit card (according to its rules and procedures) and contact us immediately. Please provide us with proof of the franchise paid (eg, a policy of the credit card issuing company). This compensation only applies to reservations made by credit card using Ricardo García Heredia's (SimplyHosted) secure server and to the unauthorized use of your credit card due to our failure or negligence, for which you are not responsible, during use. from the secure server.

3. Cancellation policy, no show (not presented) and things to consider

By making a reservation, you accept the following cancellation and no-show conditions (if you do not show up)

-Bookings canceled in the 30 days before the check-in date: In case of cancellation, only the cleaning fee will be refunded.

-Bookings canceled before 30 days before the check-in date: If the reservation is canceled up to 30 days before check-in, 50% of the total amount will be refunded. All reservations can be canceled free of charge within 4 hours of the reservation confirmation time.

If a guest does not show up (no show), no amount will be refunded. If you have to cancel a reservation due to an unforeseen circumstance beyond your control, we may exempt you from cancellation penalties.

Below you will find a list of the situations covered by our Special Circumstance Cancellation Policy.

Before canceling, check if your case is included in it and if you can provide the requested documentation.

Causes that require documentation:

Death of a guest, or a direct family member or caregiver.In these cases, you must provide one of these documents:

•Death certificate.

• School notice.

• Press article in which the deceased is mentioned.

• Police report.

Unexpected serious illness or injury affecting a member of the traveler group. You must present a medical certificate confirming that the person cannot stay or travel due to a serious and unexpected illness or injury. In addition, its delivery date must be later than the one on which the reservation was made and you will have to send it to us within 14 days of cancellation. Pre-existing diseases known to the user at the time of booking are not covered.

Obligations imposed by the authorities, including subpoenas to be a member of a popular jury, travel restrictions, court appearances or absence due to a military mission. You must provide a copy of the official statement issued after the confirmation of the reservation in which the name of the person subject to any of these obligations appears.

Causes that require a case-by-case study:

No need to provide specific documentation; Our team evaluates each case to confirm if the circumstances have directly affected you.

Natural disasters, terrorism, and civil or political disturbances prevent the guest from traveling to or from the destination or that do not guarantee a safe stay.

Epidemics that suddenly affect a region or a group of people.

Diseases that are already associated with a given area, such as malaria in Thailand or dengue in Hawaii, are excluded. The measures we take if there is an outbreak of any disease and the extent of these will depend on official statements issued by the World Health Organization and local authorities.

Travel restrictions imposed by the public administration, a law enforcement agency, or a military entity that restrict movement to or from the location of the accommodation or experience.

Notices about security threats issued concerning the location of the accommodation or the traveler's experience or place of departure.

Interruptions of basic public supplies that affect the place where the accommodation is located or where the experience will take place.

Changes in the requirements to apply for a visa or passport that prevent you from traveling to your destination, without including the loss or expiration of the documents necessary for it.

Please note that cancellation supplements may apply according to the cancellation, payment (in advance) and no show (if you do not show up) or that you may not benefit from the refund of the amount paid (in advance).

We recommend that you read these conditions carefully before making the reservation and that you remember to make the subsequent payments on time as they may be necessary for the reservation If you are going to be late or late on the day of check-in or if you arrive the next day, be sure to communicate it (promptly and in due time) to Ricardo García Heredia (SimplyHosted) so that we know when you will arrive and thus avoid canceling your Book or charge the supplement for not showing up. Ricardo García Heredia (SimplyHosted) is not responsible for the consequences that your delay may have, or for any cancellation or charge for not showing up that the accommodation’s owner may carry out.

4. Cancellations of the reservation by the property

Ricardo García Heredia (SimplyHosted) promised not to double book (overbooked) and to do everything possible to ensure that the properties are ready and available on the dates of the reservations. In those cases due to force majeure, such as breakdowns, personnel problems, deaths, etc., the property is not available, Ricardo García Heredia (SimplyHosted) will notify the traveler and offer a property of equal or better benefits. If this is not possible, or guests do not accept the alternative, Ricardo García Heredia (SimplyHosted) is only responsible for returning the amount of the reservation, without higher amounts being derived for any reason.

5 Rules of use, guest numbers, and misuse.

Generally, the following rules apply to the use of any of our properties:

-The properties do not allow pets or smoke unless otherwise specified.

-Guests with pets are encouraged to call or contact us for additional fees (up to € 50 per stay).

-All guests over the age of 16 must present an official photo identification document.

-No parties or events are allowed.

-Only visits are allowed with prior approval and only until 8 p.m.

-Check-in hours are from 4 pm to 10 pm. Check out time is until 11 a.m.

-Guests must report their arrival time at least 5 hours in advance. If this is not possible, the entry could be delayed up to 5 hours without this giving rise to compensation of any kind.

-Early check-in and late check-in and check-out may be available on request, depending on availability.

To these rules, others specific to each property may be added.

Guests agree that upon booking, violation of these rules may result in a surcharge of up to € 300 and immediate expulsion of the property without refund. Guests will have to report any breakage or problem that occurs in the property. If the damages are greater than € 10, these must be paid by the guest. If the damage is not reported, this will carry a surcharge of € 50 as a service fee for the repair.

All Reservations are made for a fixed number of guests. Allowing more guests than indicated in the reservation will carry a surcharge of up to € 500 per guest per night, in addition to the immediate expulsion of the property without refund.

6. Correspondence and communication (additional)

By making a Reservation, you agree to receive an e-mail, which we can send you shortly before your arrival date, where you will find information about the destination and other information and offers (including third-party offers, as long as you have agreed to receive them), which are relevant to your destination Reservation, an email after arrival to assess (the experience with) the accommodation, and an email, which we can send you after your stay, inviting you to complete an opinion form. Check our privacy and cookies policy for more information about how we can contact you. In order to properly complete and secure your Reservation, you need to use a correct email address. We are not responsible for (nor are we obliged to verify) any errors or misspellings in the email address, or any inaccurate or erroneous (mobile) phone number or credit card number. Any complaint or claim against Ricardo García Heredia (SimplyHosted) or regarding the Travel Service it provides must be made immediately, or at most, within 30 days after the expected date of consumption of the product or service (for example, The date of departure). Any complaint or claim sent outside the 30 days can be rejected and the claimant will lose all right to any type of compensation (for damage or cost). Due to continuous updates and adjustments to rates and availability, we strongly recommend taking screenshots when making a reservation to support your argument (if necessary).

Notice for consumers in the European Economic Area: it is recommended that you first inform us of any claim through the Customer Service. If that doesn't solve the problem, you can file the claim through the European Union's online dispute resolution platform, which you'll find here: http://ec.europa.eu/odr.

7. Disclaimer

Following the limitations indicated in these terms and conditions, and to the extent permitted by law, we are only responsible for the direct damages you suffer, pay or incur due to defects attributable to our obligations in relation to our services, up to a total amount of the cost of your Reservation. However, and to the extent permitted by law, neither we nor any of our directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliates, licensees, attorneys or other persons involved in the process of creation, sponsorship and promotion of the website and its contents will be responsible for: (i) punitive, special, indirect or consequential losses or damages, production losses, profits, income, contracts, as well as loss or damage to customers or reputation and losses of demands; (ii) errors related to the description of the information (including information on prices, availability and classifications) of the accommodation on our Platform; (iii) services provided or products offered by the owner or other business partners; (iv) losses, damages or costs (direct, indirect, consequential or punitive) that you suffer, contract or pay, arising from or related to the use, unavailability or delay of our Platform; or (v) any type of (personal) injury, death, property damage or other damages, losses and expenses (direct or indirect, consequential or punitive) that you suffer, contract or pay, whether due to (legal) acts , errors, infringements, (obvious) negligence, deliberate professional misconduct, omissions, breaches, erroneous representation, objective non-contractual liability or (completely or partially) attributable to the owner or other business partners (including any of its employees, directors, staff, attorneys-in-fact, representatives, subcontractors or affiliated companies) whose products or services (directly or indirectly) are available, offered or promoted on or through our Platform, including any (partial) cancellation, overbooking, strike, force majeure or other act that escapes under our control. Ricardo García Heredia (SimplyHosted) is not responsible (and disclaims any liability) for the use, validity, quality, relevance, adequacy, and disclosure of the Trip and makes no representations, warranties or conditions of any kind in this regard, whether implicit, regulatory or of any other type, including any implicit guarantee of commercialization, title, non-compliance or adequacy of a specific purpose. You agree and accept that the relevant owner is solely responsible and assumes all responsibility and obligation regarding the Trip (including any warranty and representation made by the owner). Ricardo García Heredia (SimplyHosted) is not the (re) seller of the Trip. Complaints and claims regarding Travel (including everything related to the price offered (which may be special or a promotion), conditions or specific requests made by Clients) must be handled with the Travel Provider. Ricardo García Heredia (SimplyHosted) is not responsible and declines all responsibility concerning said complaints, claims and obligations (of the product). You agree that the owner is, at all times, responsible for the collection, retention, shipping, and payment of applicable taxes on the total amount of the price (of the Reserve) to the relevant tax authorities. Ricardo García Heredia (SimplyHosted) is not responsible for sending, collecting, withholding or paying price taxes (from the Reserve) to the relevant tax authorities. Ricardo García Heredia (SimplyHosted) does not act as the official seller of any product or service available on the Platform.

8. Applicable laws, jurisdiction and conflict resolution

Both these terms and conditions and the provision of our services will be governed and interpreted following Spanish legislation. Without prejudice to the chosen legislation, a natural person who uses any of our services for a purpose that can be considered outside their commercial or professional activity (hereinafter, the "consumer") may be subject to the mandatory provisions of the legislation of your country of habitual residence (that is, the provisions that, according to the regulations of that country, must be applied independently of this choice of applicable law clause; hereinafter, the "Mandatory Provisions"). Any conflict arising from these general terms and conditions and our services will be resolved only in the competent courts of Cádiz, Spain. Without prejudice to the jurisdiction clause, a consumer may also initiate legal proceedings on the application of the relevant Mandatory Provisions in the courts of the country where his domicile is recorded, and it is possible that proceedings against a consumer can only be initiated in the courts of his country of residence. In case of dispute over the content or interpretation of the terms and conditions, as well as in the event of conflicts, contradictions or discrepancies between the Spanish version and the other versions in other languages, the Spanish version of these terms prevails and it is conclusive to the extent that it is permitted by law. If any provision of these terms and conditions is or becomes invalid or non-binding, you will continue to be linked to the other provisions mentioned. If this occurs, the invalid provision must be complied with to the maximum extent permitted by applicable law and, to the extent possible, an effect similar to that of invalid or non-binding provisions will be accepted, in accordance with the content and purpose of these terms and terms.
